These Terms of Service (“Terms”) govern your access to ironhorsegps.com and purchase or use of Iron Horse GPS hardware, software, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.
Eligibility
You must be at least 18 years old and able to form a binding contract. If you use the Services on behalf of a business, you represent that you have authority to bind that business.
Orders and payment
Prices, taxes, and shipping are shown at checkout. Payments are processed by our payment provider. We may refuse or cancel orders in cases of errors, fraud risk, or product unavailability.
Shipping and title
Title and risk of loss pass according to the carrier and terms stated in your order confirmation. Delivery times are estimates only.
Acceptable use and remote commands
GPS hardware may include features such as remote engine stop and starter interrupt. You agree to use these features only where legal, only on vehicles you own or are authorized to manage, and in a manner that does not endanger people or property. You are responsible for compliance with federal, state, and local laws. Misuse may result in suspension or termination of Services.
Service and connectivity
GPS and cellular performance depend on coverage, installation, and environmental factors. We do not guarantee uninterrupted service or specific location accuracy. A separate data/service plan may be required and is subject to carrier terms.
Installation
Professional installation is strongly recommended. Improper installation may affect performance, void certain protections, or create safety risks. We are not liable for issues caused solely by improper installation unless otherwise required by law.
Warranty disclaimer
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the maximum extent allowed.
Limitation of liability
To the maximum extent permitted by law, Iron Horse GPS and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for any claim relating to the Services will not exceed the greater of (a) amounts you paid to us for the specific product or service giving rise to the claim in the twelve months before the claim, or (b) one hundred U.S. dollars (US$100).
Indemnity
You will defend and indemnify Iron Horse GPS against claims arising from your misuse of the Services, your violation of these Terms, or your violation of applicable law.
Changes
We may modify these Terms or the Services. If we make material changes, we will provide notice as appropriate (for example, posting on the Site). Continued use after changes become effective constitutes acceptance.
Governing law
These Terms are governed by the laws of the jurisdiction where Iron Horse GPS is organized, without regard to conflict-of-law rules, except where consumer protection laws require otherwise.
